Birth Injury Results in $8.5 Million Verdict

Thanks to the hard work of attorneys William S. Jacobson and Thomas Mester, MetroHealth Medical Center in Cleveland has been ordered to pay $8.5 million to an Ohio woman whose now 3-year-old child suffered a severe birth injury due to the hospital’s negligence.

The child stopped breathing upon delivery, but the head obstetric nurse waited five minutes before alerting the hospital’s neonatal resuscitation experts—a delay that caused serious brain damage due to lack of oxygen. As a result of the injury, the child is tube-fed, cannot speak or walk, and will require lifelong care.

This verdict, which came after 15 hours of deliberation by the jury, represents another major victory for Nurenberg, Paris, Heller & McCarthy’s clients.
